In the United States, healthcare providers, institutions, and society have failed to ensure the conditions necessary for racial and ethnic minority communities to be in good health. Many scholars and federal government officials consider racial and ethnic disparities in health to be an injustice and have called for national attention and strategies to eliminate them. Several of these strategies, including cultural competency, focus on addressing deficiencies within the health care system. Cultural competency is the ability of a healthcare (...) provider to function effectively in the context of cultural differences with the clients they serve. Increasing cultural competency among healthcare providers has been shown to improve the quality of healthcare received by racial and ethnic minorities, which contributes to reducing health disparities. Achieving equity in the quality of healthcare received is a necessary strategy, but is insufficient for eliminating disparities in the health status of racial and ethnic minority populations. A growing body of literature reveals that health disparities are determined, not only by inequities in health care, but by social factors. The implication is that strategies that focus solely on healthcare perpetuate the misconception that health status is determined by access to or quality of healthcare. To eliminate racial and ethnic disparities in health status, the fundamental conditions for good health, which include but are not limited to healthcare equity, must be acknowledged and ensured for all people. Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not (...) been inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. Approximately a quarter of a billion people around the world suffer from malaria each year. Most cases are located in sub-Saharan Africa where Anopheles gambiae mosquitoes are the principal vectors of this public health problem. With the use of CRISPR-based gene drives, the population of mosquitoes can be modified, eventually causing their extinction. First, we discuss the moral status of the organism and argue that using genetically modified mosquitoes to combat malaria should not be abandoned based on some moral value (...) of A. gambiae. Secondly, we argue that environmental impact studies should be performed to obtain an accurate account of the possible effects of a potential eradication of the organism. However, the risks from the purposeful extinction of A. gambiae should not overtake the benefits of eradicating malaria and risk assessments should be used to determine acceptable risks. Thirdly, we argue that the eventual release of the genetically modified mosquitoes will depend on transparency, community involvement, and cooperation between different nations. (shrink)

Given the popularity and success of the Hindu-Right in India's electoral politics today, how may one study ostensibly 'Western' concepts and ideas, such as the secular and its family of cognates, like secularism, secularisation and secularity in non-Western societies without assuming them simply as derivative, or colonial legacies or contrast cases of Western societies? While recognizing that the dominant language of political modernity of Western societies is not easily translatable in non-Western societies, The Secular Imaginary elaborates upon an intellectual (...) history of secularity in modern India by focusing on the two most influential political leaders – M.K. Gandhi and Jawaharlal Nehru. It is an intellectual history of both idea(s) and intellectuals, which sheds light on Indian narratives of secularity – the Gandhian sarva dharma samabhava, Nehruvian secularism, and unity in diversity. The first National Bioethics Conference in India was held from 25 to 27 November 2005 at the YMCA and Rail Nikunj, in Mumbai, India, under the aegis of the Indian Journal of Medical Ethics. Twenty institutions from all over the country participated in organising the conference, including All India Institute of Medical Sciences from Delhi, King Edward Memorial Hospital, Forum for Medical Ethics Society and Jaslok Hospital from Mumbai, National AIDS Research Institute from Pune, (...) From a largely Western phenomenon, the “animal turn” has, in recent years, gone global. Animals and Human Society in Asia: Historical, Cultural and Ethical Perspectives is just such a timely product that testifies to this trend.But why Asia? The editors, in their very helpful overview essay, have from the outset justified the volume's focus on Asia and ensured that this is not simply a matter of lacuna filling. The reasons they set out include: the fact that Asia is the (...) cradle of early human settlement and animal domestication; Asia encompasses an extreme diversity of closely connected ecosystems and human cultures; Asia is the place where the world's major religions originated; and, as in other parts of the world, Asia's use of animals for food and other utilitarian purposes constitutes a prominent feature of its culture. Turning away from the dynamic of warfare, the following two chapters explore the biopolitical question of the management of the horse as a bio-resource in the Mamluk Sultanate of Egypt and Syria (1250–1517) and early Ming Dynasty China, respectively. The first one places its focus on the breeding, procurement, and feeding of the horse subjects in question, while the latter concentrates on the human organization of various resources for the upkeep of government horses—a conventional area of study called “horse administration” in the institutional history of the government in China.The last section, “Animals in Culture and Religion,” examines the changing images of apex predators, such as lions and tigers, in Buddhist perceptions from South Asia to East Asia; the cult of the Horse King in late Imperial China; and the significance of animal signs in Mongolian historiography. They represent an established approach in animal studies that seeks to understand different aspects of human culture through symbolic or metaphorical animals. Instead of treating the animals discussed as mere abstractions, which has been a frequent criticism of works that adopt this approach, the relations between the symbolic animals and their prototype in the natural world were attentively explored. The essay on the cult of the Horse King, for example, closely links the wax and wane of the cult since late imperial China with the changing use and subsequent disuse of the actual horses in agriculture, transportation, commerce, and quotidian life. Yet, classic as these essays on symbolic animals are, one does feel slightly unsatiated when coming to the end of this section, which also marks the end of this volume. Having been reminded early in the introductory essay that Asia was “a major site for the emergence of moral teachings and ethical guidance on the treatment of animals” and how this legacy “still affects the lives of billions of humans to this very day,” one feels naturally rather let down that no article in this volume directly addresses this vital ethical dimension, especially since it belongs to a series on “animal ethics.”Indeed, regarding the task of placing either the nonhuman animals or the ethical relations between humans and other animals center stage, the essays in this volume achieve only varying levels of success. Some authors exhibit a more acute awareness of what “animal studies” or “animal ethics” might entail epistemically and methodically and experiment by paying closer attention to the species-specific characteristics, experience, and agency of nonhuman animals in order to cast off the deified anthropocentrism previously ruled in humanist scholarship. However, others have made no such attempt. For example, in Part II of “Animals as Food,” an essay on the production and consumption of milk in contemporary China, albeit alert to the issue of health hazards to consumers, omits any consideration of the subject from the dairy cows’ perspective under the modern intensive farming system. Moreover, otherwise superb research on the tuna-fishing industry in Japan, with its insightful discussion of the nexus between knowledge economies and imperial politics, too passes over any discussion of the fate of the tuna, whether collectively as a group of living organisms containing 15 species or individually as animals with an embodied experience. One does ponder whether these essays would fit better in a volume on the cultural history of food or on the entwining history of knowledge production, economics, and politics, which conventionally position human interests at the center of research.Taken as a whole, this is an impressive volume that directs our attention to the hitherto understudied world of Asia in animal studies. The long durée, with its interdisciplinary and interregional approach, also most powerfully presents a past in Asia that could not have been the same without the participation of animals at every level, from everyday life to the shaping of cultural values, the construction of belief systems, the building of a national identity, and even the rise and fall of regimes. Scholars and students interested in expanding the frontier of our understanding of the world with a more inclusive “we” should find a wealth of interesting subjects on which to build further research. Finally, the volume also presents a fitting occasion for all scholars committed to animal studies to consider the grave challenge confronting the field that arose alongside its growing respectability and rapid expansion: Should it be oriented toward the destabilization of our previously anthropocentric conception of the world? Or should no such perimeter be imposed, as in this volume? The overall breadth and limitations of this volume leave one pondering this issue. (shrink)

Here he introduced to the educated public of Continental Europe the theory about the affinity of Sanskrit to Greek, Latin and German, twenty-two years after this theory, which is now called "the Indo-European relationship," was presented by Sir William Jones to the members of the Asiatick Society in Calcutta. The presentation of this linguistic relationship, together with a call to study languages by a historical-comparative method, comprised the first part of the book. The second part dealt with Indian philosophy, which according to Schlegel, belonged to the tradition of all Oriental philosophy. The third part suggested how the study of Indian literature might benefit the study of history in general. Central to this view was the speculation that Indian civilization had emigrated to Europe, supported by the linguistic affinity between Sanskrit and European languages.The recommendation in the quotation above was well received. The excitement stirred by Schlegel's book reflected the growing interest in India and the East among European intellectuals. This was a very complex process that was a product of Europe's growing colonial power in Asia but was also a part of the modernization of European thought. The relationship between the ethical standards for the governance of clinical trials and market forces can be complex and problematic. This article uses India as a case study to explore this nexus. From the mid-2000s, India became a popular destination for foreign-sponsored clinical trials. The Indian government had sought to both attract clinical trials and ensure these would be run in line with internationally accepted ethical norms. Reports of controversial medical research, however, triggered debate about the robustness and (...) suitability of India's regulatory system. In response to civil society pressure and interventions by the Supreme Court, the Indian government proposed additional measures aimed at strengthening protections for clinical trial participants. Whilst the reforms can be seen as a victory for human rights activists, they have also been criticised as being overly burdensome for sponsors. Indeed, their announcement prompted an exodus of clinical trials from India. Fearful of losing business to ‘rival’ countries, the Indian government is revisiting some of its proposals. The Indian example suggests that research ethics frameworks and national policies for economic development are increasingly intertwined. Host countries are in theory free to improve the lot of research participants, but doing so may make them appear less attractive to foreign sponsors, who can simply shift their activities to more industry-friendly jurisdictions. Although these economic pressures are unlikely to lead to a regulatory ‘race to the bottom’, they may limit host countries' ability to enact socially desirable reforms. (shrink)

The purpose of this study is to explore the extent and nature of sustainability disclosure practices of companies from environmentally sensitive industries in India. It further investigates the influence of potential determinants on sustainability information disclosure of the companies. The study analyzed the data of 57 energy and mining companies included in NIFTY500 index at National Stock Exchange of India (NSE) for the period 2016 to 2019. In the present study, environment, social, and governance (ESG) parameters were (...) considered to measure the corporate sustainability disclosure practices. Panel data analysis was conducted to investigate the impact of possible determinants on sustainability reporting. The results indicate that variables, such as firm size, market capitalization, and a standalone sustainability reporting, are positively associated with the sustainability information disclosure of companies. The finding also suggests that policymakers should promote a standalone sustainability reporting based on Global Reporting Initiative (GRI) standards and also broaden the existing scope of business responsibility reporting in India. Overall findings should help the policymakers and regulators to assess and advance the disclosure reforms to improve sustainability reporting in India. (shrink)

Over the past 6 months, coronavirus-induced disease has spread across 212 countries, affecting millions of people. As it has no known cure, social distancing is highly recommended for prevention of spread of the disease. Here, we have described the impact of the social distancing measures implemented by the Government of India on various sections of the society, especially the vulnerable sections. Furthermore, we have presented an analysis of these measures, according to the World Health Organization´s Guidance for Managing (...) Ethical Issues in Infectious Disease Outbreaks ; we have also applied principles, as applicable, from the Indian Council of Medical Research’s National Ethical Guidelines for Biomedical and Health Research Involving Human Participants. Fortunately, there have been several notable attempts. Throughout his works, Richard Shusterman frequently incorporates the perspectives of various East Asian philosophies into his articulation of somaesthetics. Multiple scholars have explored John Dewey’s lectures in China and their political and educational impact, such as Jessica Ching-Sze Wang’s John Dewey in China or The Democracy of the Dead by Roger T. Ames and David L. Hall. Still others have highlighted the influence of Indian thought on pragmatism’s forerunners, such as American Philosophy Before Pragmatism (Goodman 2015), American Pragmatism: An Introduction (Spencer 2020), and The Ethics of Oneness (Engles 2021). Perhaps the most interesting inquiries into this influence can be found in a special volume of The Journal of Aesthetic Education (Vol. 43, No. 1) where multiple scholars discuss pragmatism’s connections and comparisons to The Bhagavad Gita, Confucianism, and Taoism. Among these scholars is Scott Stroud whose most recent publication The Evolution of Pragmatism in India (2023) represents the culmination of nearly two decades of research on the subject with special attention to the continuities between pragmatism and Indian thought. In it, he meticulously explores the influence of John Dewey on one of his students, Bhimrao Ambedkar (1891–1956), who was a transformative figure in the founding of the nascent Republic of India. The result is a work of scholarship that shows the global relevance of pragmatism in the 20th Century, [End Page 456] introduces the fascinating philosophy of Ambedkar to a non-Indian audience, and provides an entry for further scholarship on this profound thinker and activist.Bhimrao Ambedkar was a critical figure in the birth of modern India. Born an “untouchable” due to the rigid caste system, he tirelessly advocated for the right of Dalits (“crushed” or “untouchables”). By the mid-20th century, he had greatly influenced Indian politics, safeguarded the interests of the oppressed, and played a key role in drafting the Indian Constitution. Separate to his role as a statesman, Ambedkar promoted Buddhism in the 1950s as an escape from caste oppression, culminating in his publication, The Buddha and His Dhamma (1957). While his name is less familiar outside of India, he was voted the “Greatest Indian” in a 2012 poll due to his profound impact on the nation’s post-independence development. These accomplishments were supported by an extensive education, but unlike most subjects of the British Empire, Ambedkar also studied in the United States. Stroud initiates his study by focusing on this formative period, specifically his time at Columbia University and the influence of the philosopher and psychologist John Dewey. While their relationship has been acknowledged, Stroud is the first to explore this relationship in depth and he not only reconstructs the influence of Dewey on Ambedkar’s Navayana Pragmatism but illuminates the ways that Ambedkar integrated, modified, and even resisted Dewey’s pragmatism.Stroud masterfully builds his reconstruction of this synergy between Dewey’s pragmatism and Ambedkar’s philosophy not out of ephemeral conjecture or pithy textual evidence, but through painstaking, detailed, and exhaustive scholarship. He draws on comparative evidence in their major and minor works, their private correspondence, interviews of Ambedekar’s cohort at Columbia, Dewey’s voluminous lecture notes, and even the marginalia and notecards found between the pages of Ambedkar’s pragmatism bookshelf. Indeed, I often found myself pleasantly distracted as I imagined Stroud’s academic pilgrimage throughout India, Columbia University, and the Center for Dewey Studies to find every scrap of relevant information. There is myriad of legislations enacted in the past to curb the offences, but the crimes in the society seem to be unstoppable. During the COVID time, in the lockdown too, the crimes continued to take place. There were several instances of domestic violence and rapes heard in news. Many instances of suicides were reported. It is really difficult to (...) understand what place in the country is safe for the existence and peaceful survival of any person? The question that arises is whether a victim who comes before the court is provided with the adequate relief? Has the Judiciary or the Parliament done something with this regard? Does the concept of compensatory jurisprudence exist in India? What more is required to be done to enhance the position of victims and rehabilitate them? The research article shall look into the concept of compensatory jurisprudence with respect to India and other nation states as well. There are prevailing enormous laws which discuss about the punishment to be given to the accused person guilty to have committed crime, but unfortunately, there is no specific law regarding the steps to be taken to rehabilitate a victim who has been the subject matter of any crime. The research paper shall deal with various aspects and try to analyse laws or rules, if any, existing with regard to the protection of victims in India or around the globe. It shall also try to look into the role that the States play in rehabilitating and compensating the sufferers and victims of various crimes. This article is based on field work with the Vivekananda Kendra in Kanyakumari, India. The Vivekananda Kendra is a Hindu spiritual organization founded in 1972, based on principles promoted by Swami Vivekananda. The organization’s members translate Vivekananda’s Vedanta and Yoga ideals into national reconstruction. The efforts of Eknath Ranade as the key transmitter of Vivekananda’s ideals, the way he effectively wove austerity, renunciation, and service to realize them, and the Kendra’s strategy of social service and its effects are (...) discussed. In particular, the Kendra’s social service is analyzed on the basis of its social consciousness, its views on social issues and gender, its Hindu nationalist stance, and its relationship with the establishment and the global political economy. This critical discourse highlights the Kendra’s emphasis on Vedantic socialism as opposed to traditional socialism. The lenses by which the Kendra views society are gendered and ethnonationalist. It deals with matters of justice, equity, and state relations from a benevolent patriarchal vantage point. (shrink)

No doubt the Western conceptualization of the East generally served to subjugate the Indians to their colonial rulers, but it also provided a set of beliefs to which disgruntled Western occultists and radicals, and also Western-educated Indians, could appeal in order to defend the dignity and worth of Indian religion and society. No doubt the founding theosophists had no intention of promoting political radicalism on the subcontinent, but the discourse they helped to establish provided others with an instrument they (...) could use for political ends. Indeed, the formation of the Indian National Congress shows how Western-educated Indians were able to join with Hume to promote their political ends using the particular advantages that involvement in the Theosophical Society had given them. The founders of the Indian National Congress relied on the contacts and commitments generated within the Society; they relied on a capacity for, and a belief in, cooperation, both at an all-India level and also between Indian nationalists and liberal Britons; and they relied on a background discourse that emphasized the strength and claims of India, its heritage and religion.Although we have focused on the origins of the Indian National Congress, the process we have uncovered continued to operate for much of the nationalist era. Annie Besant, like Hume and Sinnett, used theosophy to resolve the Victorian crisis of faith after she had spent some time investigating spiritualist phenomena, and her theosophy combined with her radicalism to take her into the nationalist movement, where she became the only Western woman ever to be elected as president of the Indian National Congress (Taylor 1992). Gandhi (1948), like Malabari, Rao, and Sen, used theosophy to help restore his pride in his native culture to support his vision of ancient India as a vital, rational, and moral society. British occultists such as Besant and Western-educated Indians such as Gandhi turned to theosophy for different reasons, but once they had done so, they shared practices and intellectual commitments that helped sustain the nationalist movement. The need to inscribe political analysis with a feeling of historical acceleration was nowhere as patent as in George W. Bush's New World Order. Although the "New World Order" quickly (...) gave way to the euphemism "globalization," it soon became obvious that political agendas would change considerably as would the terms of engagement with realities that had once seemed straightforward and now appeared riddled with theoretical problems.Nationalism was salient among those realities. Although it had driven decolonization in the fifties and sixties and throughout the Vietnam era, it seemed to flare up roughly at the time when Bush pronounced the bipolar order dead. As the political map was being redrawn after the breakdown of the Soviet empire, other foci of political struggle caught the world's attention. National struggles in other regions were interpreted as collateral of that breakdown rather than long-standing symptoms of similar tensions at different scales. Once more, the European continent was caught in the incongruity of its historical processes. While Western Europe was cautiously advancing toward economic and political integration, Eastern Europe found itself returning from a "posthistorical" experiment in supranationalism to the "historical" horizon of polities being reconfigured according to such social tangibles as a common language and religion, a traditional relation to place, and shared identifying memories.Until the 1990s the West smugly believed that it had consolidated state borders around seemingly homogeneous societies. Cultural integration was flaky in spots (Northern Ireland, the Basque Country, Corsica); those resistances, however, were looked on mostly as archaic irrelevances bound to disappear. But as nationalism began to haunt the cozy dream of a posthistorical balance of power, nonchalance gave way to a glut of intellectual exorcisms meant to conjure the evil that had caught at Europe's edges. In this new context, the Balkans represented for Europe, in Žižek's words, "the peculiar status of a ghost that haunts it." If the Balkans "are always somewhere else, a little bit more toward the southeast" [3], in the 1990s the danger of Balkanization seemed ubiquitous. At the time, a true Balkan hysteria rang out in the most self-satisfied European nations. In France and Spain, long-standing conflicts between center and periphery were recast in terms of the horror seen on CNN. Europe spatialized its fears, turning geographic distance into a metaphor for the racism directed against its internal others.Europe's internal others did not consist only of immigrants from non-EU countries, for whom liberals always had a soft spot, but also of those peoples and territorial units capable and culpable of tearing admirable nations apart. It was in those territorial units, which had been incorporated but not assimilated in the course of nation-state building, that nationalism was "raising its ugly head." It was here that "'reflexive' Politically Correct racism" (Žižek) applied the Balkans metaphor, projecting every conceivable horror into the intentions of unsuspecting citizens. As Žižek observed at the time, "[t]he [End Page 46] Balkans constitute a place of exception with regard to which the tolerant multiculturalist is allowed to act out his/her repressed racism" [6]. This perverse acting out was all the more acceptable, inasmuch as the peoples subjected to the logic of displaced racism were after all white and developed, and thus free game for the tolerant multiculturalist, who could always bring forward less-developed regions as potential victims of the centrifugal region's egotism. When the Balkans war broke out in May of 1991, the first Western European reactions were predominantly pro-Serbian. Never mind that Slovenia and Croatia were pro-Western and democratic. Western intelligentsias accused them of pettiness and lack of solidarity and began to restrain their large-state bias only when Serbian annexationists directed their all-out war against Bosnian Muslims, who, although white and no less developed than their attackers, were, by virtue of their religion, a patent instance of otherness. Religious and secular convictions have powerful effects, but their fundaments are often surprisingly fragile. Because of the conspicuous role that nationalisms, populisms, and fundamentalisms have in our globalizing world it is essential not to take their strength for granted, but to acknowledge that conviction and doubt are part of the same dynamic. The chapters in this volume demonstrate that doubt and hesitation are daily concerns even among the Maoist movement in India, right-wing populists in Europe and newly pious Somali (...) Muslims in London. In fact, new converts are often such stringent believers precisely because they need to dispel their own lingering doubts, while revolutionary movements survive only through the denial of ambiguity. By studying everyday doubt this volume unravels the mechanisms by which convictions gain and lose their force, and analyzes the dynamics that propel loosely held ideas into committed action. Whereas a focus on overcoming doubt highlights the exclusionary effects of committed action, attention to the breakdown of belief serves to better understand the cycles of hope, conviction, and disillusion that bespeak the human condition. This is the central theme in several chapters looking at ideological break-down. The collapse of communism, for instance, produced an epistemological crisis in which all knowledge became unstable, prompting gold-miners in Mongolia to go as far as to doubt the cosmos. The post-ideological environment of Western democracies also produces anxieties, as the break-down of the bonds of trust between governments and citizens results in feelings of betrayal. Questions of truth and action are always related: if nothing is worth fighting for then apathy and hopelessness may become symptomatic. By paying attention to the mechanisms and dynamics by which specific ideas gain and lose their credibility this volume sheds important new light on the role of ideas in social and political action. Today, property rights have occupied tremendous academic and political space because of their close affiliation to human rights. At the global forums, the right to property is often advocated as a "fundamental human right" essential for the integrity of the individual, and also crucial to freedom, prosperity, and realizing equality. However, beyond the human rights proposal, economic development in the globalization decade has affected the state policies that have disturbed the sanctity of property rights for many households. Owing to such (...) occurrences, the issue of ‘property’ is now one of the biggest concerns of the state and the society, giving adequate reasons to question or dispute illusionary human rights discourse on property. In India, the harsh reality of land acquisition in the exercise of the power of eminent domain has reduced property to a mere political construct. The conflicts over acquisition and subsequent social exclusion have begun to expand their ambit and have taken over the streets, courtrooms, and public spaces. This paper attempts to put forth substantial arguments to satisfy that a human rights discourse on the property is either faulty or ignorant of reality, if devoid of context. Also, theorizing on property rights does not suffice as a standard for reasonable reforms in state policy vis-à-vis property. -/- . (shrink)

Among the key ideas of the Bengal Renaissance was one of a future India considered from the point of view of India's weal. An creative embodiment of the idea in Rabindranath Tagore’s poem ‘Where the Mind is Without Fear’ is analyzed in the article. Based on hermeneutical approach, the author traces an origin of the idea, its evolution in creative thought of the national-cultural renaissance in Modern India and its content in Tagore’s thought. The application of (...) a principle of historicism helped to trace the emergence of ‘dreamland’ idea in Michael Madhusudan Dutta’s poetry, then its ‘antithesis’ in philosophy by Swami Vivekananda and next transformation into the image of future free India in Rabindranath Tagore’s poem. For the first time ‘Where the Mind is Without Fear’ has been philosophically considered in the broad context of the history of thought and culture in India from Rammohun Roy to Rabindranath Tagore. The poem is an application of social ideal of free society to future perspective of India; its practical embodiment is possible, but it depends from positive activity of Indian people. The poem represents a set of key ideas of the epoch such as renovation of spiritual life, overcoming of the dead rules, rational thinking of all life spheres, human liberation from traditional dependencies, finding of dignity and discovery of new ways of development. Moreover, Tagore maintains universal human problematic of freedom and circumstances of its embodiment in peoples’ life. (shrink)

Wilson, vol. 1 (London: James Madden, 1848), 309. 404 Gyanendra Pandey writers dredged up the condition of women, familial relations, and domestic life in India to demonstrate the necessity of colonialist-initiated improvement and reform.3 Colonial rule thus provided the impetus for “a thoroughgoing re-evaluation of Indian ‘tradition’ along lines more consonant with [a] ‘modern’ economy and society.”4 Faced with insistent colonial critique, nationalist reformers and thinkers set out to controvert suppositions about the fallen state of Indian women and the oppressiveness of Indian homes. They also further sought to ameliorate conditions where these had deviated from their version of a glorious past. The Hindi/Urdu writer Premchand sums up the nationalist rebuttal in a 1931 essay entitled “Nari-jati ke adhikar” (“The Rights of Women”): “In fact, the Indian woman has always been considered the goddess of the home, and she has a higher status than men in the society.” For a variety of reasons, Premchand suggests, women fell from this preeminent position over time and men began to appropriate the established rights of women. “But,” he concludes, “the [new] wave of nationalism and enlightenment that has arrived now will obliterate all these [gender] distinctions, and our mothers [sic] will be re-installed in the exalted place that is their right.”5 It was in this way that early nationalist thinkers and spokespersons produced an argument about the existence of a sacred and relatively uncolonized “inner” space of Indian society, as contrasted with a more quickly changing, compromised, and negotiated “outer” space. In what is now a familiar precept in South Asian gender history, women were cast as the (predominant) custodians of “tradition” in private and in public life; men were (predominantly) the instruments of national, social, and cultural transformation in the wider, public domain. With this framing came propositions about the need for rapid progress in the “outer” realms of science, industry, and voluntary association as well as the later goals of welfare and development, secularism, and socialism. Purpose This paper aims to expose the challenges facing the attempt by Jamaica to introduce a new digital ID system without adequate regard to public consultation and the rights of citizens. Design/methodology/approach The method used is critical text analysis and policy analysis, providing background and relevant factors leading up to the legislative changes under review. Extensive literature sources were consulted and the relevant sections of the Jamaican constitution referenced and analysed. Findings The case study may have national peculiarities not (...) applicable in other jurisdictions. Its introduction acknowledges that the Jamaican Government may amend and re-submit the legislation, absent the flawed clauses. The paper however will remain valid given its detailed analysis and exposure of risks associated with biometric data collection, face recognition technology and data storage flaws. Practical implications It will be a practical example of the risks associated with flawed biometric data collection and the role of Courts in reviewing such legislation. Referrals to the Courts can be used as a remedy, as occurred not only in Jamaica but also in many other jurisdictions, including India and Kenya. Social implications The paper foregrounds the rights of citizens to be consulted on the collection and storage of their sensitive biometric data. The social implications and risks of violating the constitutional rights of citizens were made evident, and can be an example to other jurisdictions. Originality/value The paper is the first of its kind to provide detailed data and analysis on an outright rejection by the Courts of a country's ID legislation on grounds that it violated the constitution and rights of citizens. It shows the ethical and social challenges in proposing and implementing legislation without adequate public consultation on such sensitive matters as biometric data. It also exposes some of the challenges of artificial intelligence and face recognition technologies in ID data collection, including flaws related to race, gender and coding. (shrink)

Abstract This paper begins with an introduction to the ancient spiritual tradition of India. The focus is upon aspects of ancient Indian philosophy relevant to modern society. In the Indian context, science and spirituality are complementary. The application of ethical and religious motivations derived from these ideas is delineated with respect to the practical implementation of energy projects. The efforts of religious and social groups in promoting renewable energy in India are included. A few bioenergy technologies relevant (...) to rural communities in developing nations are then described. The paper argues that though scientific research, technology development, community-based efforts, environmental activism, and renewable energy policy making are important elements in dealing with the energy crisis, they are not sufficient to solve the crisis. The paper closes with the premise that the main wisdom to be drawn from the religious, spiritual, and philosophical traditions concerns the inner transformation that is key to meeting today's energy and environmental crisis.
